We are seeking a U.S.-licensed attorney with federal court experience to review, finalize, and file three separate applications under 28 U.S.C. §1782 seeking limited document discovery from three U.S.-based companies for use in a pending UK High Court proceeding.
The underlying foreign matter is pending in the High Court of Justice of England and Wales, King’s Bench Division, Media and Communications List.
The work is intended to be tightly scoped and efficient. Draft application materials have already been substantially prepared, including the core §1782 application, memorandum of law, supporting declaration, proposed order, exhibit structure, and proposed Rule 45 document subpoena.
Scope of work
Counsel would be asked to:
1. Review and revise the prepared §1782 materials for legal sufficiency.
2. Confirm the correct federal district and filing procedure for each target.
3. Ensure compliance with the applicable district court local rules and Rule 45.
4. Confirm that the statutory §1782 requirements and Intel discretionary factors are properly addressed.
5. Finalize and file each application.
6. Finalize and issue the resulting Rule 45 subpoenas if the applications are granted.
7. Handle any routine procedural follow-up with the courts and, if necessary, limited meet-and-confer correspondence with the subpoena recipients.
8. Discovery sought
The discovery is deliberately narrow and seeks only documents. No depositions are contemplated.
The three companies are located in different US jurisdictions and may therefore require separate filings in California and Colorado.
We are looking for someone who:
1. Is admitted to practice in the relevant federal district(s), or can work efficiently with local counsel where necessary. (California and Colorado) for filing purposes.
2. Has experience with federal civil procedure and Rule 45 subpoenas.
3. Ideally has handled 28 U.S.C. §1782 applications, international discovery, or cross-border litigation.
4. Is comfortable working from substantially completed draft materials rather than starting from scratch.
5. Can handle the matters efficiently and cost-effectively.
7. Can move quickly once the supporting UK court documents are finalized.
The objective is not broad U.S. litigation. This is a focused international discovery exercise designed to obtain a discrete set of documents for use in the pending High Court proceeding.
